- Eligibility: To enter, you must be 18 years of age or older and a legal resident of the United States and you must not be an employee, officer or director of Helzberg Diamonds or any of its affiliates, parent companies, advertising and promotional agencies, promotional partners or any other entity or person involved in the development, production, implementation, administration or fulfillment of the Sweepstakes or an immediate family member of any such person (collectively, "Affiliates").
- Drawings and Prizes: Helzberg Diamonds will hold one Nationwide Drawing on or about July 1, 2010, in which one Grand Prize Winner will be randomly selected from among all qualified entries received on a nationwide basis consistent with these Official Rules. Additionally, on or about July 1, 2010, each Helzberg Diamonds store will hold one Store-Specific Drawing in which one Store Winner will be randomly selected from among all qualified entries received by that store consistent with these Official Rules. Helzberg Diamonds has the sole authority to determine the Prize Winners and its decisions are final and binding in all respects. The specific prizes and their Verifiable Retail Value ("VRV") are:
- Nationwide Drawing: One Grand Prize consisting of a 18kt, 1-Carat TW Helzberg Diamond Masterpiece® (ring setting with mounted diamond) (VRV $7,499).
- Store-Specific Drawings: For each of Helzberg Diamonds' stores (including, as a separate store and drawing, the Helzberg Diamonds' website and the pool of individuals who enter online as described in 3(a) below), a ¼ Carat TW loose diamond (VRV $285).
All prizes will be awarded except to the extent Helzberg Diamonds is unable to award one or more of the prizes after making a reasonable number of attempts to award such prize(s), as determined by Helzberg Diamonds in its sole discretion. The prizes are not transferable or redeemable for cash and cannot be refunded or exchanged except at the discretion of Helzberg Diamonds.
- Methods of Entry: The entry period begins February 20, 2010 and ends May 9, 2010. Only one entry per person in the Nationwide Drawing and one entry in one Store-Specific Drawing per person will be accepted, regardless of the method of entry. You may enter in any one of the following ways:
- Online Entry: You may enter into both the Nationwide Drawing and one Store-Specific Drawing (the website store) by completing and submitting an Official Entry Form online at www.helzberg.com by 11:59 p.m. (CT) on May 9, 2010; or
- In-Store Entry: You may enter into both the Nationwide Drawing and one Store-Specific Drawing by completing an Official Entry Form at a Helzberg Diamonds' store and depositing it in the sweepstakes deposit box of that store by close of business on May 9, 2010.
To constitute a valid Online or In-Store Entry, you must submit on the entry form your name, telephone number, email address (optional for in-store entry only) and home address. All late, lost, damaged, misdirected, incomplete, illegible, undeliverable or destroyed entries are invalid entries, regardless of the cause, including, but not limited to, any problem or technical malfunction of any computer system or server or technical problem or traffic congestion on the Internet or at our website. Helzberg Diamonds reserves the right to, at its sole discretion, cancel, suspend and/or modify this Sweepstakes or any individual drawing or disqualify any individual or entry, as Helzberg Diamonds deems appropriate for purposes of protecting the integrity of this Sweepstakes or addressing changes in business operations or other circumstances.
- Odds: The odds that a valid entry will be selected to win a prize in the Nationwide Drawing are 1 out of the total number of valid entries received for the Nationwide Drawing. The odds that a valid entry will be selected to win a Store-Specific Drawing are 1 out of the total number of valid entries received for the Store-Specific Drawing. Because entries are available to all store and website visitors, the total number of entries and exact odds cannot be determined
- Claiming Prize:
- Nationwide Drawing: The Prize Winner in the Nationwide Drawing will be notified by email, phone or U.S. mail. The Prize Winner must complete, sign and return as directed to Helzberg Diamonds within 30 days after the date of Helzberg Diamonds' first notice of award an IRS Form W-9, an Affidavit of Eligibility, Waiver of Liability and, where permitted by law, Publicity Release.
- Store-Specific Drawings: Each Prize Winner in a Store-Specific Drawing will be notified by email or phone. Each Prize Winner must return to that specific store and claim the prize within 20 days of the date of Helzberg Diamonds' first notice of award. The Prize Winner must complete, sign and return as directed an Affidavit of Eligibility, Waiver of Liability and, where permitted by law, Publicity Release.
Each Prize Winner is responsible for any and all federal, state and local taxes, fees and other applicable government assessments on the awarded prize. If the Prize Winner fails to timely respond or is determined ineligible after review of identification, then the Prize Winner will be disqualified and an alternate Prize Winner will be selected by random drawing as described in (a) or (b) above, as applicable.
- Waiver and Release: By participating in this promotion, each entrant agrees: (a) to be bound by these Official Rules and the decisions of Helzberg Diamonds; (b) to release and hold harmless Helzberg Diamonds and Affiliates from any and all losses, damages, claims and actions of any kind arising from this promotion (including, without limitation, claims based on publicity rights, defamation or invasion of privacy) or from the acceptance, possession or use of any awarded prize; (c) that any action at law or in equity arising out of or relating to this promotion or a prize shall be governed by the law specified in 7 below and shall be filed only in state or federal courts located in Clay County, Missouri and entrant consents to the personal jurisdiction of such courts for purposes of any such action; and (d) that Helzberg Diamonds is not responsible for and cannot be held liable for unauthorized human intervention, technical errors, printing errors, mail delays, and any errors in the administration of this Sweepstakes.
- Applicable Law and Geographic Area: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by and construed in accordance with the laws of the State of Missouri without giving effect to any choice of law or conflict of law rule of any jurisdiction. This promotion is void outside the United States and where prohibited by law.
