  1. NO PURCHASE IS NECESSARY AND WILL NOT IMPROVE YOUR CHANCE OF WINNING.
     
  2. Eligibility: To enter, you must be 18 years of age or older and a legal resident of the United States, and you must not be an employee, officer or director of Helzberg Diamonds or any of its affiliated companies (including advertising and credit agencies) or an immediate family member of any such person. Helzberg Diamonds and all above-identified affiliates and individuals are collectively referred to in these Official Rules as “Helzberg Diamonds and Affiliates”.
     
  3. Prize: The prize is a $5,000 shopping spree at Helzberg Diamonds, which must be completed within one year of the date of prize award. The prize is not transferable or redeemable for cash or substitution and prize merchandise selected by prize winner cannot be subsequently refunded or exchanged. The prize winner is responsible for any and all federal, state and local taxes, fees and other government assessments on the awarded prize.
     
  4. Entry: The entry period begins May 12, 2008 and ends September 6, 2008. Only one entry per person will be accepted. You may enter by: (a) completing an official entry form at any Helzberg Diamonds’ retail store and depositing it in a sweepstakes deposit box at the store by the close of business on September 6, 2008; or (b) completing an online entry and submitting it electronically by 11:59 p.m. Central Standard Time on September 6, 2008. To constitute a valid entry, you must meet the eligibility requirements in 2 above and timely submit on the entry form your name, telephone number, email address (if you have one) and home address. All late, lost, damaged, misdirected, incomplete, illegible, undelivered or destroyed entries are invalid entries, regardless of the cause, including, but not limited to, any problem or technical malfunction of any computer, network or server or any technical problem or traffic / congestion with respect to the Internet or the Helzberg Diamonds website. Helzberg Diamonds reserves the rights to, at its sole discretion, disqualify any individual who tampers with the entry or drawing process.
     
  5. Drawing: Around September 19, 2008, Helzberg Diamonds will determine a prize winner by randomly selecting one entry from among all valid entries received on a nationwide basis consistent with these Official Rules. Helzberg Diamonds has the sole authority to determine the prize winner and its decisions are final and binding in all respects
     
  6. Odds: The odds that a valid entry will be selected are one out of the total number of valid entries. Because entries are available to all store and website visitors, the maximum number of entries and the odds cannot be determined.
     
  7. Claiming Prize, Alternate: The prize winner will be notified by telephone or mail. To claim the prize, the prize winner must complete, sign and return as directed to Helzberg Diamonds within 30 days after the date of the first notice of award an Affidavit of Eligibility, Waiver of Liability, IRS Form W-9 and, where permitted by law, Publicity Release. If the prize winner fails to timely respond or comply with these requirements or if Helzberg Diamonds determines the prize winner is ineligible after review of the Affidavit, then the prize winner will be disqualified and an alternate prize winner will be selected by random drawing as described in 5 above. By participating in this promotion, all entrants agree to be bound by these Official Rules and the decisions of Helzberg Diamonds as the sponsor.
     
  8. Waiver and Release: By participating in this promotion, each participant agrees to release and hold harmless Helzberg Diamonds and Affiliates from any and all losses, damages, claims and actions of any kind arising from this promotion (including, without limitation, claims based on publicity rights, defamation or invasion of privacy) or from the acceptance, possession or use of any awarded prize.
     
  9. Applicable Law and Geographic Area: All federal, state and local laws and regulations apply. This promotion is void outside the United States and where prohibited by law.
     
  10. Sponsor and Winners List: The name and address of the sponsor of this promotion is Helzberg’s Diamond Shops, Inc., and the address of its headquarters is 1825 Swift Avenue, North Kansas City, Missouri 64116. You may obtain the name of the prize winner by sending a request to the above address, together with a stamped, self-addressed, #10 envelope.
