At Helzberg Diamonds, we understand that a jewelry purchase is an investment in yourself or in someone you care for, so we stand behind your purchase with a guarantee which demonstrates to you that we believe in the quality of our jewelry and value your continued business. Developed at the request of our customers, the Helzberg Diamonds Lifetime Care Plan is an extension of this commitment.

Lifetime Care Plan Terms & Conditions

To protect and preserve your new jewelry and lifetime plan, please follow the conditions outlined below. If you have any questions, please be sure to contact the Helzberg Diamonds store at which you purchased this Lifetime Care Plan or Helzberg Diamonds’ corporate headquarters located at 1825 Swift, North Kansas City, Missouri 64116-3671.

Instructions:

Upon signup and payment of the purchase price (shown on the attached receipt) for coverage of the new jewelry under this Lifetime Care Plan, you’ll be issued this Lifetime Care Plan Kit. You’ll need to bring this with you for all check-ups and repairs. It’s also a good idea to keep the receipt from your purchase and the information about this Lifetime Care Plan for your records.

Check-up & Repairs:

In order to keep the Lifetime Care Plan in effect, you must have your jewelry inspected by a Helzberg Diamonds Associate during the six months following the date of purchase and every six months thereafter. If you do not, your coverage under this Lifetime Care Plan will become invalid. Just bring your jewelry to your nearest Helzberg Diamonds store along with this Lifetime Care Plan Kit. Your kit will be used to verify your membership in the program and enable us to maintain a detailed history of the service provided. All check-ups and Covered Repairs and Services are a part of the purchase price of this plan. When we have completed the inspection and any needed repairs, all you have to do is pick up the jewelry at the same store where you dropped it off. What Repairs and Services are Covered:

This Lifetime Care Plan covers all inspections, cleaning and Covered Repairs and Services to the jewelry covered by this Plan. Covered Repairs and Services include the parts and labor necessary to fix problems which occur during normal usage of the jewelry, consistent with the conditions for which it was designed. Depending on the type of jewelry for which the Plan coverage is purchased, it would include shortening of diamond bracelets, resizing or reshanking of rings, the replacement of lost or damaged semi-precious gemstones and lab-created gemstones, restringing of pearls, clasp replacement, repair of broken chains, repair of worn or broken prongs, repair of broken earring posts or similar repairs.

What is Not Covered

Jewelry that is not brought in for its regular six-month check-up or that has been damaged as a result of excessive or abusive treatment, or has been repaired by a store other than Helzberg Diamonds is not covered by this Lifetime Care Plan. This plan also does not cover loss or theft of the jewelry, damage resulting to the jewelry from loss, theft or Act of God, or any consequential damages or loss of use resulting from the broken or damaged jewelry, or from any delay in our repairing the jewelry. Please note that none of our care plans cover complete loss.

Cost

Our Lifetime Care Plan covers a variety of services and repairs over the lifetime of your jewelry, all for a one-time cost that is sure to pay for itself many times over. The cost of your Lifetime Care Plan is based on the original retail value of your jewelry purchase - view estimated repair costs below:

With a Lifetime Care Plan, these and many other repair costs are covered in your one-time plan cost. This can be especially valuable on engagement rings and other diamond jewelry that may require multiple services throughout their lifetime. Please note that none of our guarantees, including Lifetime Care Plan, cover complete loss.

Covered Period

This Lifetime Care Plan gives you coverage for the lifetime of the jewelry from the date of purchase. This coverage applies only to the jewelry listed on this plan and is not transferable to other jewelry items purchased.

Transferable

This Lifetime Care Plan applies to the original customer, the original gift recipient of the jewelry and subsequent gift recipients of the jewelry, so long as he or she is in possession of both the jewelry and this Lifetime Care Plan Kit.

Cancellation

You may cancel this Lifetime Care Plan at any time within 60 days after the date of purchase by returning the Kit with your receipt to the Helzberg Diamonds store at which the jewelry was purchased. Otherwise, this Plan is non-cancelable and nonrefundable.

Entire Agreement

The above constitutes the entire terms and conditions of this Lifetime Care Plan and no such terms or conditions may be amended without the mutual written agreement of both parties. Helzberg Diamonds' obligations under this Plan are backed by its full faith and credit. The attached receipt held in the slip portion of the service contract contains the service contract number and product description, and is herby incorporated by reference. We are glad the associate listed on the receipt was able to assist you in making this responsible choice. The obligor, or service contract provider, is Helzberg's Diamond Shops, Inc. Helzberg Diamonds' corporate office address is 1825 Swift, North Kansas City, MO 64116.

California/Oregon Addendum
This Lifetime Care Plan is guaranteed by Berkshire Hathaway. Helzberg's Diamond Shops, Inc. is a 100% owned subsidiary of Berkshire Hathaway. Berkshire Hathaway agrees to guarantee all obligations of Helzberg Diamonds relating to the operation of a care plan in your state during such time as Berkshire maintains ownership of Helzberg. This guarantee is irrevocable as long as there is in force in your state any contract or any obligation arising from Helzberg service contracts sold while Berkshire owned Helzberg. Florida Addendum
The rate charged for this contract is not subject to regulation by the Florida Office of Insurance Regulation. In the event the contract is canceled by the warranty holder, return of premium shall be based upon 90% of unearned pro rata premium less any claims that have been paid or less the cost of repairs made on behalf of the warranty holder. In the event the contact is cancelled by the association, return of premium shall be based upon 100% of unearned pro rata premium less any claims paid or the cost of repairs made on behalf of the warranty holder.

Georgia Addendum
If this Lifetime Care Plan is cancelled within the first sixty (60) days you will receive a 100% refund. If you cancel after sixty (60) days of receipt of your contract, you will receive a pro rata refund of the contract price. In the event of cancellation by Helzberg Diamonds, notice of such cancellation will be in writing and given at least 30 days prior to cancellation. Cancellation will comply with Section 33-24-44 of the Code of Georgia. Claims paid and cancellation fees shall not be deducted from any refund owed as a result of cancellation by Helzberg or you. Helzberg may not cancel this contract except for fraud, misrepresentation, or non-payment by you. Any refund owed and not paid as required is subject to a penalty of 25% of the refund owed and interest of 18% per year until paid, however, such penalty shall not exceed 50% of the amount of the refund. This is not a contract of insurance.Obligations of the obligor under this contract are insured by a bond with Hartford Fire Insurance Company. If you file a claim under this contract and the obligor fails to pay or provide service within sixty (60) days of such filing such claim, or if you are otherwise dissatisfied, please submit your claim in writing and a copy of this contract and the sales receipt for the product to The Hartford Fidelity & Bonding (BOND) Hartford Plaza, 690 Asylum Avenue, Hartford, CT 06115.

Illinois, Arizona, Nevada and California Addendum
For Illinois, Arizona, California and Nevada customers only, this Lifetime Care Plan may be cancelled at any time during its term, subject to the following conditions: If this Lifetime Care Plan is cancelled within the first sixty (60) days of the coverage period and so long as you return the Lifetime Care Plan Kit with your receipt, Helzberg Diamonds will refund the entire purchase price (100%). If this Plan is cancelled at anytime thereafter and so long as you return the Lifetime Care Plan Kit with your receipt, Helzberg Diamonds will refund to you a prorata portion of the purchase price based on the following calculation. A time period of 7 years will be used to calculate a pro-rata refund. To calculate the month in which coverage began under this Lifetime Care Plan, it will be considered a month only if this Lifetime Care Plan was purchased before the 15th of such month. The month in which this plan was cancelled will be considered a covered month only if it is cancelled after the 15th of such month. Prorata refunds will be given based on the number of months remaining in the extended warranty period, divided by 84, multiplied by the original selling price. For example, a $179.99 plan purchased on January 7, 2008, and returned on July 7, 2008, would have 78 months remaining out of 84, so the calculation would be 78/84 x $179.99, to arrive at a refund amount of $167.13.

Nevada Only
Any pre-existing conditions are covered by the Lifetime Care Plan. No prior approval is needed for repairs. In the event covered service is not provided by Helzberg Diamonds within sixty (60) days of proof of loss by the contract holder, the contract holder is entitled to apply directly to Berkshire Hathaway 3555 Farnam Street #1440 Omaha, NE 68131

South Carolina Addendum
For any disputed claims, you may contact: South Carolina Department of Insurance Capital Center, 1201 Main Street, Suite 1000 Columbia, SC 29201 (803) 737-6180. A ten percent (10%) penalty per month shall be added to a refund that is not paid or credited within forty-five (45) days after the return of the contract to the provider.

Wisconsin Addendum
THIS CONTRACT IS SUBJECT TO LIMITED REGULATION BY THE OFFICE OF THE INSURANCE COMMISSIONER OF INSURANCE.
Helzberg Diamonds may cancel this Lifetime Care Plan only for your nonpayment of the provider fee, your material misrepresentation to Helzberg Diamonds, or your substantial breach of duties relating to the covered product or its use.  
If Helzberg Diamonds cancels this Lifetime Care Plan, you will receive a written notice by mail at your last-known address contained in Helzberg Diamonds’ records.  You will receive the notice at least 5 days prior to cancellation.  The notice will state the effective date of the cancellation and the reason for the cancellation.
If Helzberg Diamonds cancels this Lifetime Care Plan for a reason other than nonpayment of the provider fee, you will receive a 100% refund of the unearned pro-rata provider fee, less any claims paid.
If you cancel this Lifetime Care Plan within the first 60 days of coverage, the Lifetime Care Plan will be void and Helzberg Diamonds will refund to you the full purchase price of this Lifetime Care Plan, so long as you return the Lifetime Care Plan Kit with your receipt and no claim has been made under this Lifetime Care Plan.  The right to void this Lifetime Care Plan is not transferable and will apply only to the original Lifetime Care Plan holder.
If you cancel this Lifetime Care Plan after the first 60 days of coverage, or if you cancel within the first 60 days but a claim was made under this Lifetime Care Plan during the first 60 days, Helzberg Diamonds will refund to you 100% of the unearned pro-rata provider fee, less any claims paid.  Helzberg will charge an administrative fee of 10% of the provider fee for such cancellations.
In the event of a total loss of the property covered by this Lifetime Care Plan that is not covered by a replacement of the property under this Lifetime Care Plan, you will be entitled to cancel this Lifetime Warranty Plan and Helzberg will refund to you 100% of the unearned pro-rata provider fee, less any claims paid.
Pro-rata refunds will be calculated using a time period of 7 years.  If Helzberg Diamonds fails to pay or credit a refund within 45 days after the return of the Lifetime Care Plan as described above, Helzberg Diamonds will pay a 10% per month penalty of the refund amount outstanding which will be added to the amount of the refund.
